STORM TRAINING & CONSULTING, LLC
COMPREHENSIVE RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS, INDEMNIFICATION, HOLD HARMLESS AGREEMENT, AND FIREARMS SAFETY ACKNOWLEDGMENT
PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
In consideration for being permitted to participate in any course, class, competition, exercise, seminar, conference, workshop, certification program, demonstration, Tactical Rescue Challenge®, firearms training, rescue training, medical training, TECC/TCCC training, force-on-force training, scenario-based training, canine training, fitness event, consulting engagement, range activity, water-based activity, vehicle-based activity, aviation-related activity, or any other activity conducted, sponsored, organized, facilitated, hosted, managed, authorized, or affiliated with Storm Training & Consulting, LLC ("STC") (collectively referred to herein as the "Activities"), I voluntarily agree as follows:
The term "Activities" shall include participation at any training site, range, educational institution, host agency, host facility, government facility, military installation, university, college, school, private property, public property, competition venue, waterway, transportation hub, lodging site, event venue, or any other location utilized by STC in connection with the Activities.
ASSUMPTION OF RISK
I understand and acknowledge that participation in the Activities involves inherent and significant risks that may result in serious bodily injury, permanent disability, illness, disease, emotional distress, property damage, paralysis, drowning, burns, hearing loss, vision loss, exposure to hazardous conditions, and death.
I understand these risks include, but are not limited to:
• Firearms, ammunition, blank-fire devices, less-lethal devices, simulation weapons, training munitions, force-on-force exercises, live-fire exercises, and weapons handling.
• Tactical, law enforcement, military, rescue, emergency response, medical, and scenario-based activities.
• Physical exertion including running, climbing, crawling, lifting, dragging, carrying, obstacle negotiation, casualty extraction, fitness testing, swimming, and other strenuous activities.
• Water-based activities including swimming, diving, submersion, water rescue operations, pool exercises, open-water operations, boating activities, and activities conducted in or around pools, lakes, rivers, ponds, oceans, docks, piers, vessels, and other bodies of water.
• Vehicle operations and vehicle-related activities, including automobiles, trucks, utility vehicles, all-terrain vehicles (ATVs), utility task vehicles (UTVs), motorcycles, bicycles, watercraft, boats, vessels, personal watercraft, aircraft, helicopters, fixed-wing aircraft, and any other mode of transportation utilized during the Activities.
• Airborne and aviation-related activities, including helicopter operations, fixed-wing aircraft operations, aircraft loading and unloading, aviation support operations, and activities conducted in proximity to aircraft.
• Exposure to smoke, loud noises, pyrotechnics, flashing lights, adverse weather, heat, cold, humidity, environmental hazards, confined spaces, elevated surfaces, rough terrain, uneven ground, naturally occurring hazards, and unforeseen conditions.
• Contact with participants, competitors, instructors, volunteers, role players, spectators, vendors, sponsors, contractors, medical personnel, rescue personnel, animals, and canines.
• Equipment failure, transportation incidents, communication failures, negligent acts of participants, and unforeseen hazards.
I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with my participation in the Activities.
RELEASE OF LIABILITY
For purposes of this Agreement, the term "Released Parties" shall include Storm Training & Consulting, LLC; Benjamin Sonstrom; all event staff, instructors, assistant instructors, volunteers, contractors, employees, officers, directors, sponsors, vendors, photographers, videographers, medical personnel, rescue personnel, emergency responders, host agencies, municipalities, counties, states, governmental entities, military organizations, military installations, law enforcement agencies, educational institutions, universities, colleges, schools, property owners, property managers, venue operators, facility operators, lessors, licensors, host facilities, training facilities, ranges, and each of their respective officers, directors, trustees, employees, volunteers, agents, representatives, successors, heirs, and assigns.
To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, judgments, and attorney fees arising from or related to my participation in the Activities.
This release expressly includes claims arising from the ordinary negligence of any Released Party to the fullest extent permitted by law.
INDEMNIFICATION, DEFENSE, AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, lawsuits, liabilities, damages, losses, judgments, settlements, fines, penalties, costs, expenses, and attorney fees arising out of or related to:
(a) my participation in any Activity;
(b) my attendance at any Activity location, venue, facility, range, training site, host agency, host property, lodging location, transportation venue, competition venue, or event site;
(c) my actions, omissions, negligence, misconduct, rule violations, unsafe acts, or failure to follow instructions;
(d) injury, illness, emotional distress, death, or property damage suffered by me or caused by me to any other person;
(e) damage to any vehicle, watercraft, vessel, aircraft, facility, range, equipment, training aid, property, or infrastructure;
(f) my use, handling, possession, transportation, storage, maintenance, or discharge of firearms, ammunition, less-lethal devices, simulation weapons, training munitions, rescue equipment, medical equipment, tools, machinery, vehicles, aircraft, watercraft, or other equipment;
(g) any claims brought by my spouse, family members, heirs, estate, beneficiaries, assigns, insurance carriers, governmental agencies, representatives, or any third party arising from or related to my participation in the Activities;
(h) any rescue, medical treatment, evacuation, transportation, extraction, recovery effort, or emergency response provided to me or necessitated by my actions;
(i) any claim arising from my violation of any law, regulation, policy, procedure, safety rule, instructor direction, event requirement, or facility rule; and
(j) any claim, lawsuit, arbitration, administrative proceeding, or legal action arising from or related to my participation in the Activities, whether asserted during or after completion of the Activities.
This indemnification obligation shall survive completion of the Activities and shall apply to the fullest extent permitted by law.
MEDICAL FITNESS
I certify that I am physically and mentally capable of safely participating in the Activities and have no condition that would make participation unreasonably dangerous to myself or others.
EMERGENCY MEDICAL AUTHORIZATION
I authorize emergency medical treatment deemed necessary by event staff, emergency responders, physicians, nurses, paramedics, or other medical personnel. I understand I am solely responsible for all resulting medical costs and expenses.
PERSONAL PROPERTY
I acknowledge that I am solely responsible for all firearms, equipment, vehicles, uniforms, electronics, protective gear, personal property, and belongings brought to or used during the Activities.
RULES AND SAFETY COMPLIANCE
I agree to comply with all event rules, instructor directions, range commands, facility regulations, safety requirements, and applicable laws. Failure to comply may result in immediate removal from the Activities without refund.
MEDIA RELEASE
I grant STC and its designees the unrestricted right to photograph, videotape, record, reproduce, publish, distribute, display, modify, and otherwise use my name, image, likeness, voice, statements, and appearance for educational, promotional, advertising, marketing, commercial, social media, website, print, broadcast, and fundraising purposes without compensation.
SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
GOVERNING LAW
This Agreement shall be interpreted and enforced in accordance with applicable law. If any provision is determined to be invalid or unenforceable under the laws of a particular jurisdiction, the remaining provisions shall remain enforceable to the fullest extent permitted by law.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, representations, understandings, and agreements relating to the subject matter herein.
This Agreement applies to all Activities conducted by Storm Training & Consulting, LLC unless specifically superseded by a separate written agreement executed by STC.
FIREARMS SAFETY RULES ACKNOWLEDGMENT
Where applicable, I acknowledge that Storm Training & Consulting, LLC has provided firearms safety rules, range regulations, standard operating procedures, and safety requirements applicable to the Activities.
I certify that I have received, read, understand, and agree to comply with all firearms safety rules, range commands, event safety procedures, and instructions issued by Storm Training & Consulting, LLC, instructors, range personnel, event staff, and host facilities.
I understand that failure to comply with any safety rule, range command, instructor direction, or event requirement may result in immediate removal from the Activity without refund.
